Important Update: The Class Administrator began issuing Individual Settlement Payments to eligible Class Members on October 27, 2022.
What is the lawsuit about?
The lawsuit primarily asserts that One Medical allegedly misrepresents to consumers that payment of the “Annual Membership Fee” is required to obtain medical care or services through One Medical offices when in fact payment is not required to obtain medical care or services, but rather is optional to obtain access to add-on membership services. Plaintiffs assert various causes of action or counts (also known as claims) based on the alleged conduct, which are listed in FAQ 2.
One Medical disagrees with Plaintiffs’ characterizations and contends that it disclosed to consumers that payment of the “Annual Membership Fee” is not required to receive medical care, but is required to receive other membership services that enhance the overall healthcare experience. One Medical denies each and every one of the allegations of unlawful conduct, any wrongdoing, any liability whatsoever. The Settlement is not an admission of any wrongdoing by One Medical or an indication that any law was violated.
Who is included?
The Settlement Class includes: "All current or former California residents that paid the ‘Annual Membership Fee’ to become a One Medical member at any time from May 2, 2014, to November 12, 2021.”
What does the Settlement provide?
The Parties have agreed that One Medical (or its affiliated healthcare technology and management company or insurers on its behalf) will fund a settlement in the amount of $11,500,000. The settlement amount will be used to pay class members, the cost of providing notice to the class and administering the settlement, and to pay any attorneys’ fees and costs the Court awards to conditional Class Counsel and any service award the Court awards to the Plaintiffs.
